COVID POLICIES:

A-Z Dance is not responsible for any COVID-19 case that is contracted on the premises or at an event where programming is provided by A-Z Dance.

Face Coverings

Face coverings are encouraged but not mandatory

Vaccines

All persons age 12 or older must be fully vaccinated against COVID-19 in order to enter the building.
By entering the premises, all persons attest that they have no knowledge of testing positive for COVID-19 in the past 5 days, nor do they have reason to believe that they will test positive for COVID-19 within the next 5 days.

While participating in events held or sponsored by A-Z Dance, LLC participants are encouraged to practice good hygiene consistent with CDC guidelines to reduce the risks of exposure to COVID-19. Because COVID-19 is extremely contagious and is spread mainly from person-to-person contact, A-Z Dance, LLC has attempted to put in place preventative measures to reduce the spread of COVID-19 by limiting attendance to vaccinated persons only. However, A-Z Dance, LLC cannot guarantee that its participants, volunteers, partners, or others in attendance will not become infected with COVID-19.

In light of the ongoing spread of COVID-19, individuals who fall within any of the categories below should not participate in A-Z Dance, LLC’s events. By attending A-Z Dance, LLC’s events, you certify that you do not fall into any of the following categories:

Currently experiencing any symptoms associated with COVID-19, which include fever, cough, and shortness of breath among others, or

Individuals who believe that they may have been exposed to a confirmed or suspected case of COVID-19 or have been diagnosed with COVID-19 within the last 5 days.

If you have participated in any activity or event that has a high risk of COVID spread (including, but not limited to, interacting with unmasked and/or unvaccinated individuals, or an event with a large group of people), please take an at home or PCR test prior to attending any A-Z Dance, LLC class, dance, or event to confirm you do not have COVID.

DUTY TO SELF-MONITOR:

Participants and volunteers agree to self-monitor for signs and symptoms of COVID-19 (symptoms typically include fever, cough, and shortness of breath) and should contact A-Z Dance, LLC at info@a-zdance.com if he/she experiences symptoms of COVID-19 within 5 days after participating in A-Z Dance, LLC’s events.

LIABILITY WAIVER AND RELEASE OF CLAIMS:

I acknowledge that I derive personal satisfaction and a benefit by virtue of my participation in A-Z Dance, LLC’s events and I willingly engage in A-Z Dance, LLC’s events (the “Activity”).

COVID-19 RELEASE AND WAIVER:

I HEREBY RELEASE, WAIVE AND FOREVER DISCHARGE ANY AND ALL LIABILITY, CLAIMS, AND DEMANDS OF WHATEVER KIND OR NATURE AGAINST A-Z Dance, INC, ITS ADMINISTRATORS, DIRECTORS, AGENTS, OFFICERS, MEMBERS, VOLUNTEERS, TEAM MEMBERS, AND EMPLOYEES, OTHER PARTICIPANTS, ANY SPONSORS, ADVERTISERS, AND, IF APPLICABLE, OWNERS AND LESSORS OF PREMISES ON WHICH THE ACTIVITY TAKES PLACE, (EACH CONSIDERED ONE OF THE RELEASEES HEREIN), EITHER IN LAW OR IN EQUITY, TO THE FULLEST EXTENT PERMISSIBLE BY LAW, INCLUDING BUT NOT LIMITED TO DAMAGES OR LOSSES CAUSED BY THE NEGLIGENCE, FAULT OR CONDUCT OF ANY KIND ON THE PART OF THE RELEASEES, INCLUDING BUT NOT LIMITED TO DEATH, BODILY INJURY, ILLNESS, ECONOMIC LOSS OR OUT OF POCKET EXPENSES, OR LOSS OR DAMAGE TO PROPERTY, WHICH I, MY HEIRS, ASSIGNEES, NEXT OF KIN AND/OR LEGALLY APPOINTED OR DESIGNATED REPRESENTATIVES, MAY HAVE OR WHICH MAY HEREINAFTER ACCRUE ON MY BEHALF, WHICH ARISE OR MAY HEREAFTER ARISE FROM PARTICIPATION WITH THE ACTIVITY.

ASSUMPTION OF THE RISK, I acknowledge and understand the following:

Participation includes possible exposure to and illness from infectious diseases including but not limited to COVID-19. While particular rules and personal discipline may reduce the risk, the risk of serious illness and death does exist, and

I knowingly and freely assume all such risks related to illness and infectious diseases, such as COVID-19, even if arising from the negligence or fault of the RELEASEES.

As a participant, I recognize that my participation, involvement and/or attendance at A-Z Dance, LLC’s events (“Activity”), is voluntary and may result in personal injury (including death) and/or property damage. By attending, observing, or participating in the Activity, I acknowledge and assume all risks and dangers associated with my participation and/or attendance at the Activity, and agree that: (a) A-Z Dance, Inc, (b) the property or site owner of the Activity, and (c) all past, present and future affiliates, successors, assigns, employees, volunteers, vendors, partners, directors, and officers, of such entities (“RELEASEES”), will not be responsible for any personal injury (including death), property damage, or other loss suffered as a result of my participation in, attendance at, and/or observation of the Activity, regardless if any such injuries or losses are caused by the negligence of any of the Releasees (collectively, the “Released Claims”). BY ATTENDING AND/OR PARTICIPATING IN THE ACTIVITY, YOU ARE DEEMED TO HAVE GIVEN FULL RELEASE OF LIABILITY TO THE RELEASED PARTIES TO THE FULLEST EXTENT PERMITTED BY LAW.

CANCELLATIONS & REFUNDS

Students must provide a minimum of 24 hours notice when canceling a private lesson or group class. Private lessons and group classes cancelled fewer than 24 hours in advance will be considered a “Late Cancel” and subject to the full charge. Coaching sessions with visiting coaches require 72 hours notice to cancel without penalty.

All fees for all programs are non-refundable and non-transferable.

MEMBERSHIP FEES

Monthly fees are automatically deducted from your checking account or charged to your credit card on the first of each month. Charges occur automatically until a membership is cancelled.

To cancel a membership, email written notice to info@a-zdance.com by the 20th of the month to stop future charges.

MULTIMEDIA RELEASE

A-Z Dance, its representatives, and its employees have the right to take photographs and/or videos of me, my child, and my property in connection with A-Z Dance activities. I authorize A-Z Dance, its assigns and transferees to copyright, use and publish the same in print and/or electronically. I agree that A-Z Dance may use such photographs and videos of me with or without my name and for any lawful purpose, including for example such purposes as publicity, illustration, advertising, and web content.

PRIVACY POLICY

Use of Your Personal Information

A-Z Dance will ask you to provide information that personally identifies you, your location or your contact information when you enroll in dance classes, purchase merchandise, request information from us, or register on our site for any other reason. We will use your personal information to fulfill your specific request and also to make contact with you related to that request.

A-Z Dance will access your personal information and/or share it with third parties only for the following purposes: (i) as needed to confirm compliance with the terms of your registration agreement or to enforce our rights under a registration agreement; (ii) if required to do so by law or to comply with legal process; (iii) to protect the rights, property, or personal safety of the public; or (iv) in connection with a merger, consolidation or sale of substantially all assets of A-Z Dance.

A-Z Dance will not sell your personal information to anyone, except that A-Z Dance may sell all rights to some or all of our products and the sale of your personal information will be part of that sale.

A-Z Dance is committed to ensuring the security of your personal information. A-Z Dance stores your personal information in secure operating environments that are not accessible by the general public. Credit card numbers are used only for processing payment. Credit card information is accepted only through a portion of our website that encrypts the credit card information before transmission for your added protection.

A-Z Dance also gathers and uses data that includes some of your personal information, but in a way that removes all of the parts of the personal information that could be used to identify you. That information is used for analyzing the effectiveness of various marketing strategies and also for analyzing the performance and use of our products. We may share this collected information for marketing or product improvements.

Cookies

Our products and websites use only “per session” cookies. These cookies do not collect information from your computer, they do not personally identify you, and they are completely erased when you close your web browser. They are used to maintain session identification while you are logged into the website. Most browsers allow users to refuse cookies. Please refer to the information about your browser. You must accept “per session” cookies to use our software.

Unsolicited Commercial Emails

A-Z Dance is committed to complying with the requirements of the CAN-SPAM Act of 2003. A-Z Dance is taking care and has implemented commercially reasonable practices and procedures designed to effectively prevent sending commercial electronic mail messages to anyone who has let us know that they do not want to receive those messages.

Opting Out

In order to opt out of receiving commercial email messages from A-Z Dance, please send an e-mail to info@a-zdance.com. If, after 15 business days, you are still receiving commercial email messages from A-Z Dance, please let us know immediately by calling this number (313) 288-2784. You may also use these contacts if you have any other questions about the operation of our website.

DISCLAIMER AND LIABILITY

RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY

AND PARENT CONSENT AGREEMENT (“AGREEMENT”)

IN CONSIDERATION of being permitted to participate in any way in any dancing activity (“Activity”) at any time during the current calendar year and all future years, I, for myself, my personal representatives, assigns, heirs and next of kin:

ACKNOWLEDGE, agree and represent that I understand the nature of dancing Activities and that I am qualified, in good health, and in proper physical condition to participate in such Activity. I further agree and warrant that if at any time I believe the conditions to be unsafe, I will immediately discontinue further participation in the Activity.

FULLY UNDERSTAND that: (a) dancing ACTIVITIES INVOLVE RISKS AND DANGERS OF SERIOUS BODILY INJURY, INCLUDING PERMANENT DISABILITY, PARALYSIS, AND DEATH (“Risks”); (b) these Risks and dangers may be caused by my own actions or inactions, the actions or inactions of others participating in the Activity, the condition in which the Activity takes place, or THE NEGLIGENCE OF THE “RELEASEES” NAMED BELOW; (c) there may be OTHER RISKS AND SOCIAL AND ECONOMIC LOSSES either not known to me or not readily foreseeable at this time; and I FULLY ACCEPT AND ASSUME ALL SUCH RISKS AND ALL RESPONSIBILITY OF LOSSES, COSTS, AND DAMAGES I incur as a result of my participation or that of the minor in the Activity.

HEREBY RELEASE, DISCHARGE, AND COVENANT NOT TO SUE A-Z Dance, Inc, its administrators, directors, agents, officers, members, volunteers, team members, and employees, other participants, and sponsors, advertisers, and, if applicable, owners and lessors of premises on which the Activity takes place, (each considered one of the RELEASEES herein) FROM ALL LIABILITY, CLAIMS, DEMANDS, LOSSES, OR DAMAGES ON MY ACCOUNT CAUSED OR ALLEGED TO BE CAUSED IN WHOLE OR IN PART BY THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, INCLUDING NEGLIGENT RESCUE OPERATIONS; AND I FURTHER AGREE that if, despite this RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT, I, or anyone on my behalf, makes a claim against any of the Releasees, I WILL INDEMNIFY, SAVE, AND HOLD HARMLESS EACH OF THE RELEASEES from any litigation expenses, attorney fees, loss, liability, damage, or cost which may be incurred as the result of such a claim.

I HAVE READ THIS AGREEMENT AND FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT AND HAVE AGREED TO IT FREELY AND WITHOUT ANY INDUCEMENT OR ASSURANCE OF ANY NATURE AND INTEND IT TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW AND AGREE THAT IF ANY PORTION OF THIS AGREEMENT IS HELD TO BE INVALID, THE BALANCE, NOTWITHSTANDING, SHALL CONTINUE IN FULL FORCE AND EFFECT.

MINOR RELEASE

AND I, THE MINOR’S PARENT AND/OR LEGAL GUARDIAN, UNDERSTAND THE NATURE OF DANCING ACTIVITIES AND THE MINOR’S EXPERIENCE AND CAPABILITIES AND BELIEVE THE MINOR TO BE QUALIFIED, IN GOOD HEALTH, AND IN PROPER PHYSICAL CONDITION TO PARTICIPATE IN SUCH ACTIVITY. I HEREBY RELEASE, DISCHARGE, COVENANT NOT TO SUE, AND AGREE TO INDEMNIFY AND SAVE AND HOLD HARMLESS EACH OF THE RELEASEES FROM ALL LIABILITY, CLAIMS, DEMANDS, LOSSES, OR DAMAGES ON THE MINOR’S ACCOUNT CAUSED OR ALLEGED TO BE CAUSED IN WHOLE OR IN PART BY THE NEGLIGENCE OF THE “RELEASEES” OR OTHERWISE, INCLUDING NEGLIGENT RESCUE OPERATIONS AND FURTHER AGREE THAT IF, DESPITE THIS RELEASE, I, THE MINOR, OR ANYONE ON THE MINOR’S BEHALF MAKES A CLAIMS AGAINST ANY OF THE RELEASEES NAMED ABOVE, I WILL INDEMNIFY, SAVE, AND HOLD HARMLESS EACH OF THE RELEASEES FROM ANY LITIGATION EXPENSES, ATTORNEY FEES, LOSS LIABILITY, DAMAGE, OR ANY COST THAT MAY OCCUR AS A RESULT OF ANY SUCH CLAIM.

BY ALLOWING A MINOR TO ATTEND AND/OR PARTICIPATE IN THE ACTIVITY, YOU ARE DEEMED TO HAVE GIVEN FULL RELEASE OF LIABILITY ON BEHALF OF THE MINOR TO THE RELEASED PARTIES TO THE FULLEST EXTENT PERMITTED BY LAW.

Alcohol is not permitted on the premises without a proper license from the city. A-Z Dance is not responsible for the actions nor the consequences of those actions of those who consume alcohol on the premises, even if a proper license has been obtained. A-Z Dance is not liable in any way for the actions nor the consequences of those actions of those who consume alcohol on the premises, even if a proper license has been obtained.
